In 2022, a jury acquitted Zhukovskyy of criminal charges in the case, but two and a half weeks ago, attorney Ryan N. McFarland, the administrative law judge, denied his request to have his driving privileges restored.
McFarland’s decision cited Zhukovskyy’s use of heroin, fentanyl and cocaine on the morning of the crash, as well as accounts from witnesses who said he was driving erratically before encountering the oncoming motorcycles.
At the hearing before McFarland and at his criminal trial two years ago, Zhukovskyy acknowledged that he had used drugs, but said he was no longer intoxicated when the collision occurred about 10 1/2 hours later. At the time, he was driving a pickup truck pulling a 42-foot trailer on behalf of Westfield Transport, which was based in West Springfield.
His defense attorneys blamed the collision on the lead motorcyclist, Albert “Woody” Mazza, Jr., 59, of Lee, NH, highlighting evidence that he was under the influence of alcohol and lost control of his motorcycle. Mazza, president of the Jarheads Motorcycle Club, died in the crash.

The other victims were from Massachusetts, Rhode Island and New Hampshire. They were Daniel Pereira, 58 years old; Aaron Perry, 45 years old; Desma Oakes, 42 years old; Michael Ferazzi, 62 years old; and Jo-Ann and Edward Corr, a couple from Lakeville, Massachusetts, who were 58 years old.
The 2019 crash exposed years of failures by Massachusetts officials, who in the weeks before the collision failed to act on two warning notices from Connecticut to suspend Zhukovskyy’s commercial driver’s license.
Connecticut officials notified their Massachusetts counterparts that Zhukovskyy’s license should be suspended after he refused to submit to a drug test on May 11, 2019. The refusal triggered an automatic license suspension. Officers in Windsor, Connecticut, asked him to submit to the test after he was arrested on charges of operating a motor vehicle under the influence of alcohol or drugs.
Zhukovskyy has pleaded not guilty in the Connecticut case, which is pending.
It is unclear whether Zhukovskyy is legally allowed to drive in Massachusetts. Last month, a Registry spokesperson declined to comment on the case, but said the agency “cannot review an individual for reinstatement of a Massachusetts credential until all out-of-state crimes have been resolved.”
On Tuesday, another spokesperson said Registry information about a “license applicant or holder is no longer public record under the law.”
Zhukovskyy also faces deportation. Zhukovskyy, a Ukrainian citizen who came to the United States as a child, was ordered deported in February 2023, according to a spokesperson for U.S. Immigration and Customs Enforcement.
But it is unclear under what circumstances immigration officials would enforce Zhukovskyy’s deportation order given the ongoing war in Ukraine, which was invaded by Russian forces in 2022. The United States granted Temporary Protected Status to Ukrainian citizens and stopped his expulsion to that country. until April of next year.
Westfield Transport, run by brothers Dunyadar and Dartanyan Gasanov, closed shortly after the accident. In 2021, a federal grand jury in Massachusetts indicted the brothers for violating federal safety regulations for the trucking industry and then falsifying records to conceal the violations.

The alleged crimes occurred before the fatal crash in New Hampshire. Both brothers pleaded not guilty, but court records show they were scheduled for a change of plea hearing on August 13.
