BROWNSVILLE, Texas (ValleyCentral) — The state of Texas, on behalf of the Texas Commission on Environmental Quality, has filed a lawsuit against Milwhite Incorporated.
The lawsuit was filed for violations of the Texas Clean Air Act and seeks injunctive relief, civil penalties, attorneys’ fees and costs, and any other relief available under the law, according to a news release.

The city of Brownsville filed a lawsuit against Milwhite Inc. after residents on King James Street complained about constant dust from the plant that covered the neighborhood and made residents sick.
State Representative Erin Elizabeth Gámez and Brownsville City Commissioner Linda C. Macías issued the following joint statement:
“The violations of which Milwhite is accused are incredibly serious and dangerous. Due to excessive dust that has lasted for more than a year, our constituents fear they have suffered respiratory problems and loss of enjoyment of their outdoor spaces.”

They added that the situation unfortunately led to a lawsuit. However, they affirm that it is necessary for the State of Texas to take action.

In a previous ValleyCentral report, residents said they experienced long-term health problems as a result of Milwhite Inc.
“Our property is being affected,” said Brownsville resident Adhlemy Sanchez. “We have damage to our roofs and replacing them is not cheap.”
State Senator Morgan LaMantia stated that Milwhite Inc.’s disregard for state environmental regulations can no longer be tolerated and that the lawsuit can provide much-needed relief to the community.
“When the health and quality of life of families and children are disrupted by knowingly harmful actions, we must pursue all available avenues until we reach resolution and accountability,” LaMantia added. “It is unacceptable that our neighbors in the Brownsville community have suffered health risks and disruptions due to conscious negligence, and we hope that justice is served.”
The city of Brownsville is advocating for the company to close if Milwhite Inc. does not improve conditions and prevent dust from affecting residents’ health and property.
